We, FUJIFILM Corporation, provide this Privacy Notice to describe how we collect, use, disclose and retain personal data that we collect from you when you use our “instax Biz™” application (“Application”) and certain rights you may have under applicable privacy laws. If you are a resident of California, please also see our California Consumer Privacy Act Privacy Policy here. For purposes of this Privacy Notice, “personal data” means information that uniquely identifies, relates to, describes, or is reasonably capable of being associated or linked to, you.
1. What Personal Data Do We Collect?
We collect the following personal data when you use our Application:
• Template Data: Template frame you created in the Application;
• Inquiry Data: Any information that you voluntarily submit to us when you make an inquiry, submit a comment, or otherwise contact us;
• Technical Data: Data concerning the use of your Application such as IP address, cookie, version information of the Application, information on your device and OS, connection status with such device, browsing information and number of prints on this Application (per Application and per device); and
• User ID: A random sequence of numbers linked to you when you first download the Application.
Please ensure that you have the consent of others before putting their photos or other personal data into our Application.
2. Tracking Technologies
We use various analytics services, including Google Analytics, to assist us with collecting and analyzing Technical Data. To learn more about Google Analytics, visit Google’s Privacy Policy and Google’s page on “How Google uses data when you use our partners’ sites or apps.” You may download the Google Analytics Opt-out Browser Add-on for each web browser you use, but this does not prevent the use of other analytics tools. You can manage your preferences with respect to these technologies by visiting the “Settings” page in the Application.
3. For What Purposes Do We Use Your Personal Data?
We use your personal data for the following purposes:
• To provide you with the services, features and functions of the Application;
• To customize, secure and improve our Application and similar or related products and services;
• To respond to your inquiries and comments;
• To create statistical information that does not identify individuals, which we use for market research and marketing purposes;
• To the extent required for benchmarking, data analysis, audits, developing new products, facilitating product, software and applications development, improving the Application or our services, conducting research, analysis, studies or surveys, identifying usage trends, as well as for other analytics purposes;
• To comply with the law, our legal obligations and legal process, such as warrants, subpoenas, court orders, and regulatory or law enforcement requests;
• To investigate, prevent, detect and take action regarding fraud, unauthorized access, contraventions of our contracts with users, situations involving potential threats to the rights or safety of any person or third party, or other unauthorized activities or misconduct;
• To manage and respond to actual and potential legal disputes and claims, and to otherwise establish, defend, enforce or protect our rights and interests;
• To support or give effect to any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy or restructuring of all or part of our business; and
• To the extent necessary for any other lawful purpose for which the personal data is collected.
4. To Whom Do We Disclose Personal Data?
We only disclose your personal data in the following circumstances and in accordance with applicable laws:
• Service Providers: We may disclose your personal data to our vendors who process it on our behalf as necessary for us to provide you with our services via the Application.
• With your Consent: We may disclose your personal data to third parties for marketing purposes with your consent, if consent is required by applicable law.
• Business Transactions: We may disclose your personal data to third parties to support or give effect to any actual or contemplated merger, acquisition, asset sale or transfer, financing, bankruptcy or restructuring of all or part of our business.
• Legal Process: We may disclose your personal data to government agencies and third parties, including law enforcement agencies and dispute resolution bodies, where permitted or required by applicable laws, such as to comply with comply with a court order, subpoena, summons or legal investigation.
• Emergencies: We may disclose your personal data to third parties where there is an immediate need for disclosure to protect human life or human rights.
5. For How Long Do We Retain Personal Data?
We will retain your Personal Information for as long as necessary to fulfill the purposes for which it has been collected, as outlined in this Privacy Notice, or any longer retention period required by law. We will retain your data as long as necessary to achieve the purposes listed above, usually for the duration of any contractual relationship and for any period thereafter as legally required or permitted by applicable law.
6. How Do We Protect Your Personal Data?
We use our commercially reasonable efforts to protect the confidentiality and security of personal data we process. However, despite these efforts to store personal data in a secure operating environment, we cannot guarantee the security of personal data during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of personal data, we cannot guarantee that our security measures will prevent third parties such as hackers from illegally obtaining access to personal data.
7. What Rights Do You Have?
Depending on where you are located, and subject to certain exceptions, you may have rights to access, correct, or erase your personal data, know certain details about how we process your personal data, obtain a copy of your personal data in portable form, opt out of the sale of your personal data, or restrict or object to certain activities in which we engage with respect to your personal data. Please note that, even if you unsubscribe from certain correspondence, we may still need to contact you with important transactional or administrative information, as permitted by law. Additionally, if you withdraw your consent or object to processing, or if you choose not to provide certain personal data, we may be unable to provide some or all of our services to you
We may request additional information from you to verify your identity and complete your request. If we deny your request, we will explain why. In some states, you have the right to appeal our denial, which you may exercise by responding to the message we send to you communicating our denial stating that you appeal our decision. In these cases, we will reconsider your request and then notify you of our decision.
8. Children’s Personal Data
We do not knowingly collect or solicit personal data from children under the age of 16. We encourage parents and guardians to take an active role in their children’s online activities and interests. In the event that we learn that we have collected personal data from a child, we will promptly take steps to delete that information. We, FUJIFILM Corporation, issue this California Consumer Privacy Act Privacy Policy ("CCPA Privacy Policy") to provide information about how we collect, use, disclose and otherwise process the personal information of California residents who use the instax Biz™ application ("Application") and rights that certain California residents may have under the CCPA. This CCPA Privacy Policy only applies to you if you reside in California. This CCPA Privacy Policy does not reflect our processing of California residents' personal information where an exception under the CCPA applies.
1. Our Personal Information Handling Practices over the Preceding 12 Months
The table below sets out the categories of personal information (as defined by the CCPA) about users of our Application that we collected, sold, shared and disclosed to others over the preceding 12 months, the sources of such personal information, and the retention periods applicable to it. We do not sell or share personal information. We do not have actual knowledge that we sell or share the personal information of California residents under 16 years of age. We do not use sensitive personal information for purposes other than those specified in subsection 7027(l) of the California Consumer Privacy Act Regulations.
2. Your Rights under the CCPA
As a California resident, you may have the following rights under the CCPA:
• The right to know what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you. You may only exercise your right to know twice within a 12-month period.
• The right to delete personal information that we have collected from you, subject to certain exceptions.
• The right to correct inaccurate personal information that we maintain about you.
• The right to opt-out of the sale or sharing of your personal information by us. We do not sell or share personal information.
• The right not to receive discriminatory treatment by us for the exercise of privacy rights conferred by the CCPA.
3. How to Exercise Your CCPA Rights
• Methods of Submission and Instructions: To submit a request to exercise your rights to know, delete or correct, please fill out our online form here or contact us at (844) 901-2001.
• Verification: Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may designate an authorized agent by taking the steps outlined under "Authorized Agent" further below. In your request or in response to us seeking additional information, you, or your authorized agent, must provide sufficient information to allow us to reasonably verify that you are, in fact, the person whose personal information was collected which will depend on your prior interactions with us and the sensitivity of the personal information being requested. We may ask you for information to verify your identity and, if you do not provide enough information for us to reasonably verify your identity, we will not be able to fulfil your request. We will only use the personal information you provide to us in a request for the purposes of verifying your identity and to fulfill your request.
• Denial of Requests: We may deny certain requests, or only fulfill some in part, as permitted or required by law. For example, if you request to delete personal information, we may retain personal information that we need to retain for legal purposes.
• Authorized Agents: You can designate an authorized agent to make a request under the CCPA on your behalf if we receive a written authorization stating that you have authorized the authorized agent to submit a request on your behalf which has been signed by you and the authorized agent and we have verified the identity of you and the authorized agent. If you provide an authorized agent with power of attorney pursuant to California Probate Code sections 4000 to 4465, it may not be necessary to perform the above steps, and we will respond to any request from the authorized agent in accordance with the CCPA.
